1. About these terms

These Terms of Use cover the FoodKeep website and app provided by BALANCED LLC (“FoodKeep”, “we”, “us” or “our”). By using them, you agree to these terms. If you do not agree, stop using the service.

The website currently introduces an app being prepared for release. Features, availability and paid plans may change before launch. A preview does not create a paid subscription or reserve a price.

If you use the iOS app, Apple’s Standard Licensed Application End User License Agreement also applies to the app license unless a different license is expressly provided on the App Store. These terms supplement that license for the FoodKeep service and do not limit mandatory consumer rights.

2. Using FoodKeep

You may use FoodKeep for your own lawful recipe organization, meal planning and cooking. You must be able to enter a binding agreement in your jurisdiction, or have the involvement and consent of a parent or guardian where required. The service is not directed to children under 13.

Do not use the service to infringe others’ rights, distribute unlawful content, compromise security, interfere with operation, misuse access credentials or circumvent access controls. Nothing in these terms restricts activities that applicable law does not permit us to restrict.

If you create an account where that service is offered, provide accurate information and protect your credentials. Let us know if you suspect unauthorized access. A local kitchen can be used without creating an account.

3. Your recipes and other content

You retain the rights you have in recipes, photographs, notes and other material you add. You are responsible for having permission to use and share that material. Saving a source link does not transfer rights in the source website, photographs or recipe text.

To the extent you choose to send content to FoodKeep for a service or support request, you give us a limited permission to handle it only as needed to fulfill that request and operate that service. This is not a transfer of ownership or a general license to publish or sell your private recipes.

Source websites and linked services are independent of FoodKeep. Their availability and terms may change. We do not guarantee that a link remains accessible or that any imported or manually entered recipe is complete.

4. Subscriptions, trials and billing

FoodKeep Plus may be offered as a monthly or annual auto-renewing subscription when paid features become available. Before you purchase, the app and Apple’s purchase sheet will show the features, duration, price and any introductory terms that apply to you. Offers and prices may differ by storefront, period or promotion; the offer you accept governs your purchase.

Apple handles App Store payments. A subscription renews automatically unless you cancel it through your Apple account settings. You can review and cancel subscriptions in Settings → your name → Subscriptions. For an introductory or free trial, cancel at least 24 hours before it ends if you do not want the paid subscription to begin. See Apple’s subscription cancellation instructions.

Deleting FoodKeep or deleting a FoodKeep account does not cancel an Apple subscription. Any remaining access, refunds and billing issues are handled under Apple’s applicable terms and your consumer rights. You may request an eligible refund through Apple’s purchase support. We cannot promise that Apple will approve a request.

If a price changes, the notices and consent process required by Apple and applicable law will apply. No change overrides the rights associated with an existing purchase. Trial eligibility and any limits are shown with the offer. The current preview does not initiate real purchases.

5. Cooking and recipe information

FoodKeep helps organize information; it does not verify every ingredient, quantity, cooking instruction or source. Check recipes for accuracy and suitability before cooking. You are responsible for checking allergies, dietary requirements, food storage, safe temperatures and the needs of anyone eating the food.

Recipes and related information are for general use and are not individualized medical, dietary or professional advice. Ingredient scaling and timers are conveniences and should be checked against your recipe and cooking conditions.

6. Local storage and availability

The current kitchen stores its content locally on your device. Keep suitable backups using the options available to you. We do not provide server recovery or automatic synchronization for local kitchen data. A lost device, removed app or damaged storage may make that data unavailable.

We may improve, modify or discontinue features. We will provide notice where required and respect obligations connected to paid access. Internet services and third-party links can be interrupted; we cannot promise uninterrupted operation on every device.

7. FoodKeep materials and privacy

FoodKeep’s software, branding and original website materials belong to us or our licensors. Your use of the service does not transfer ownership of those materials. You may not reproduce or distribute them beyond the permission given by the applicable license or law.

Our Privacy Policy describes how information is handled. Please read it alongside these terms. Separate providers, including Apple, have their own terms and privacy policies.

8. Responsibility and consumer rights

We provide the service with reasonable care. To the extent permitted by law, we do not make additional promises that every recipe, link or feature will be error-free or suitable for every purpose.

To the extent permitted by law, we are not responsible for indirect or consequential loss that is not reasonably foreseeable, or for losses caused by your misuse, third-party content or events beyond our reasonable control. This does not exclude liability that cannot lawfully be excluded, including applicable guarantees, fraud or other mandatory protections.

Nothing in these terms removes rights you have under consumer law. If a term conflicts with a mandatory right, that right continues to apply.

9. Ending use and resolving concerns

You may stop using FoodKeep at any time. Remove local content from your device if you no longer want to keep it, and cancel any subscription separately through Apple. Contact support about information held by us.

We may restrict an online service where reasonably necessary to address misuse, security risks or legal obligations. Where appropriate, we will explain the restriction and give you an opportunity to address the issue. Paid-service and consumer obligations continue to apply.

If there is a disagreement, contact us first so we can try to resolve it. These terms do not require mandatory arbitration or waive your right to bring a claim through courts or consumer procedures available under applicable law.

10. Updates and contact

We may update these terms as the service develops. The date on this page identifies the latest version. We will give notice of material changes as appropriate and obtain agreement where required. If you do not accept revised terms, you can stop using the service without losing any rights that already apply to a purchase.
